Terms of Service

This is a plain-language agreement. We've written it to be read, not skimmed past. If anything here is unclear, email us at info@qsoftware.ca and we'll explain it plainly.

1. Who we are, and what these terms cover

Q Software ("we", "us") builds software for local businesses. These terms govern your use of our products, including Catch — an AI missed-call text-back and appointment-booking assistant — and Reputable — a reputation and social growth workspace. By creating an account or using either product, you agree to these terms.

2. What Catch does

Catch connects to your existing business phone number. When a call to your business goes unanswered, Catch sends an automated SMS reply to the caller, answers questions about your business by text, and can book appointments into your connected calendar.

3. Fair use on the "Unlimited" plan

"Unlimited missed-call text-backs" means unlimited use for legitimate missed-call follow-ups from your real business line. As a guideline, accounts sending more than roughly 1,000 outbound messages per month may be reviewed. If your volume looks unusual, we'll contact you first — review is a conversation, not an automatic cutoff. We may throttle accounts that use the service for bulk or promotional messaging, which Catch is not built or licensed for.

4. Your responsibilities

  • You confirm you have the right to configure call forwarding on the phone number you connect, and you consent to automated SMS being sent to your callers on your behalf.
  • You are responsible for keeping the business information you configure in the dashboard — prices, hours, services, booking rules — accurate and up to date. Catch's replies are generated from that configuration.
  • You agree to use the service in compliance with applicable law, including Canada's Anti-Spam Legislation (CASL) and carrier messaging rules.

5. SMS delivery

Message delivery depends on mobile carriers and networks we don't control. We can't guarantee that any individual message is received, or that follow-ups always arrive within a specific time. The "4 seconds" figure on our site describes typical send time, not a guaranteed delivery time.

6. AI-generated responses

Replies sent by Catch, and content drafted by Reputable, are generated by AI. They are based on the information you configure and approve. You are responsible for reviewing that configuration, and Q Software is not liable for booking errors or incorrect answers caused by inaccurate or outdated business information in your dashboard.

7. Billing

  • Subscriptions are billed monthly through Stripe.
  • Paid plans start with a 14-day free trial; you won't be charged if you cancel before the trial ends.
  • You can cancel anytime from your account. Cancellation stops future charges; we don't issue refunds for partial months.

8. Termination

You may close your account at any time. We may suspend or terminate accounts that breach these terms, abuse the fair-use policy, or use the service unlawfully — where practical, we'll contact you before doing so.

9. Limitation of liability

The service is provided "as is". To the maximum extent permitted by law, Q Software's total liability for any claim related to the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect or consequential losses, including lost revenue from missed or mishandled calls, bookings, or messages.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

11. Changes and contact

If we make material changes to these terms, we'll notify account holders by email before they take effect. Questions? Write to info@qsoftware.ca.
